These terms apply to your use of the Bagpipper desktop app and the bagpipper.com website. Please read them carefully. By downloading, installing or using Bagpipper, you agree to them. If you do not agree, please do not use Bagpipper.
1. Who we are and what these terms cover
Bagpipper, Viremail and Krodium are made by Svayam Incarnation Limited, a company registered in England and Wales (company number [to be confirmed], registered office [to be confirmed]). In these terms, “we”, “us” and “our” mean Svayam Incarnation Limited.
Bagpipper is a desktop suite for business, formerly the Viremail desktop app. It brings the Viremail apps into one native desktop app, includes Krodium, a private browser, built in, and gives access to the Krodium Store. It is available for Mac, Windows and Linux.
2. Other terms that apply
- Your Viremail account and the Viremail apps (such as Mail, Vire, Calendar, Drive and the rest) are governed by the Viremail terms and the Viremail privacy policy.
- Purchases from the Krodium Store and developer listings are governed by the terms at krodium.com and the developer agreement at krodium.com/developers.
- Our privacy policy, cookie policy and acceptable use policy also apply to Bagpipper.
If these terms conflict with the Viremail terms about your Viremail account or data, the Viremail terms prevail for that matter.
3. Your licence to use Bagpipper
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Bagpipper on devices you own or control, for your own personal use or for the internal purposes of your business or organisation. If you use Bagpipper on behalf of an organisation, you confirm you have authority to bind it to these terms.
4. Restrictions
Except where the law gives you the right regardless of these terms, you must not:
- copy, modify or create derivative works of Bagpipper;
- reverse engineer, decompile or disassemble Bagpipper, or try to extract its source code, except to the extent the law allows despite this restriction;
- circumvent or disable any security feature, licence control or administrator-managed policy;
- sell, resell, rent, lease, sublicense or otherwise make Bagpipper available to others as a service;
- remove or alter any notices of ownership; or
- use Bagpipper in breach of our acceptable use policy or any law.
5. Installing on a Mac
The Mac version of Bagpipper is currently unsigned. When you open it for the first time, macOS will ask you to confirm that you want to open it. You must confirm this in macOS before the app will run. Only do so if you downloaded Bagpipper from bagpipper.com or from the official download links we provide. Installers are hosted on GitHub.
6. Your Viremail account
You need a Viremail account to use most of Bagpipper. Sign in with Viremail is also used for the Store pages on bagpipper.com. You are responsible for keeping your sign-in details secure and for activity under your account. Please tell us promptly if you think someone else has accessed your account. Business accounts may be managed by an administrator at your organisation, who can apply policies to the app, including Krodium policies such as blocked sites and download rules.
7. Beta and new features
We may release features labelled beta, preview, early access or similar. They may be incomplete, may contain errors and may change or be withdrawn at any time. Use them with that in mind, and keep your own backups of anything important.
8. Krodium and browsing
Krodium is a browser. We do not control, review or endorse the websites you visit with it. Browsing third-party websites, and downloading or running anything from them, is at your own risk. The optional blocker and other privacy features reduce some risks but cannot remove them. Take care with the sites you trust.
9. The Krodium Store and third-party apps
The Krodium Store offers extensions, web apps and desktop apps from us and from third-party developers, some free and some paid. Third-party apps are provided by their developers, who are responsible for them, for their content and for how they handle your data. We review listings, but we do not guarantee that any app is safe, accurate, suitable for your needs or free of errors. Your relationship with a developer is governed by their terms and the Krodium terms. Please read the information about an app before installing it.
10. Intellectual property
Bagpipper, Viremail and Krodium, their names, logos and marks, and all software, designs and content we provide, belong to Svayam Incarnation Limited or its licensors. Nothing in these terms transfers ownership to you. You keep all rights in the content you create and store using Bagpipper. You give us only the permissions needed to operate the services you use.
Bagpipper includes open source components, which are licensed under their own terms. Those terms apply to those components instead of section 3.
11. Feedback
If you send us suggestions or feedback, you agree that we may use them freely, without payment or obligation to you. We will not publicly credit you without your permission.
12. Availability and changes
We work to keep Bagpipper and bagpipper.com available, but we do not promise that they will be uninterrupted or free of errors. We may update, change, suspend or withdraw features, or the whole of Bagpipper, for example for maintenance, security, legal or business reasons. Where practical and reasonable, we will give notice of significant changes. We may also change these terms, as described in section 19.
13. Suspension and termination
You may stop using Bagpipper at any time by uninstalling it. We may suspend or end your access if you break these terms or our acceptable use policy, if we are required to by law, or to protect Bagpipper, other users or ourselves. Where reasonable, we will tell you why and give you a chance to put things right. When your access ends, your licence ends and you must stop using Bagpipper. Sections that by their nature should continue to apply will do so.
14. Disclaimers
Bagpipper is currently free to use. Subject to section 15, we provide Bagpipper “as is” and “as available”. We do not promise that it will meet your particular needs, or that it will be free of errors, viruses or interruption. If you use Bagpipper for business purposes, all warranties and conditions not set out in these terms are excluded to the fullest extent the law allows.
15. Limits on our liability
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- anything else that cannot be limited or excluded by law.
If you are a consumer, these terms do not affect your statutory rights, and nothing here removes any right you have under the law that cannot be excluded.
If you use Bagpipper for business purposes, then, subject to the paragraph above:
- we are not liable for any loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss; and
- our total liability to you arising out of or in connection with Bagpipper and these terms, whether in contract, tort (including negligence) or otherwise, is limited to GBP 100 in total.
We are not responsible for third-party apps, websites or services, or for loss caused by events outside our reasonable control.
16. Indemnity for business users
If you use Bagpipper for business purposes, you will compensate us for losses, damages and reasonable costs arising from a third-party claim caused by your breach of these terms or your unlawful use of Bagpipper. This does not apply to consumers.
17. Export and sanctions
You must follow all export control and sanctions laws that apply to your use of Bagpipper. You confirm that you are not located in, or acting for anyone in, a country or on a list that is subject to United Kingdom sanctions that would make your use of Bagpipper unlawful.
18. Privacy
We handle personal data as described in our privacy policy. The Viremail privacy policy applies to your Viremail account.
19. Changes to these terms
We may update these terms from time to time, for example to reflect new features or changes in the law. We will change the date at the top of this page and, for significant changes, take reasonable steps to tell you. If you keep using Bagpipper after a change takes effect, you accept the updated terms. If you do not accept them, you should stop using Bagpipper.
20. General
- Entire agreement. These terms, with the documents they refer to, are the whole agreement between you and us about Bagpipper.
- Severance. If part of these terms is found to be unenforceable, the rest stays in force.
- No waiver. If we do not enforce a right straight away, that does not mean we give it up.
- Transfer. You may not transfer your rights under these terms. We may transfer ours to a successor of our business.
- Third parties. Nobody else has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
21. Governing law
These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom where you live.
